What are criminal cases?
Criminal cases are legal actions that relate to incidents that constitute crimes punishable by law, and vary in their nature and the penalties prescribed for them according to the type of crime and the circumstances of its commission and the available evidence regarding it.
Criminal cases are distinguished from other types of claims by the fact that their outcome may affect the freedom of the accused and their fundamental rights, thus requiring a detailed study of the circumstances, examination of evidence, and review of investigative procedures, and legal texts related to them.
In criminal cases, it is not sufficient to deal with the case merely as a collection of documents; rather, the circumstances should be understood from all aspects, and the correct legal description should be determined, along with examining the evidence and pleas that may affect the course of the claim.
What are the types of criminal cases?
The types of criminal cases vary according to the nature of the crime, and some of the most common include:
1. Misdemeanor Cases
These are cases that relate to crimes punishable by law with less severe penalties than felonies, and examples include – depending on the circumstances and applicable legal text – some cases of battery and injury, defamation, and some petty crimes such as theft and breach of trust.
2. Felony Cases
These are among the most serious types of crimes, and their nature and prescribed penalties vary according to the legal text and the circumstances, including cases of murder, bodily assaults, and crimes whose penalties are determined within the context of felonies.
3. Economic Crimes
These include a range of crimes associated with economic and financial activities, and may in some cases be subject to the jurisdiction of economic courts per the relevant regulations.
4. Cyber Crimes
With the advancement of technology, crimes related to the use of information technology to commit criminal acts have emerged, such as some forms of privacy violation or hacking accounts or data or committing crimes using information technology, according to the regulated laws applicable to the circumstances.
5. Tax Evasion Crimes
The incidents related to the amendment of evidence in documents or records as defined by law include a detailed study for the local investigator of the charges, how to deal with them, the criminal intent, and forensic reports and expertise whenever available.
6. Drug Cases
The accusations related to possession or trafficking or dealing or other actions that the law criminalizes require a thorough examination of the incidents and procedures for arrest, investigation, evidence, and technical reports.
What are the degrees of jurisdiction in criminal cases?
The stages of viewing a criminal case differ according to the type of case, specialization, nature of the ruling, and possibility of appeal.
In general, the criminal case may pass through stages before a competent court, then there will be ways to challenge determined by the law, reaching in the cases permitted by law to the Court of Cassation.
The criminal courts in Egypt – depending on the type and specialty of the case – are divided into courts that consider felony cases and other courts that specialize in misdemeanors, and there are particular jurisdictions and specialties for certain types of crimes.
The Court of Cassation is specialized in reviewing appeals that the law allows against rulings, and the court formally addresses principles and provisions related to criminal appeals and rulings of crimes and felonies.
Thus, handling the case from the beginning in a proper manner can importantly affect the construction of the defense in the subsequent stages.
